Texas Commercial Vehicle Insurance Requirements

In Texas, the minimum liability insurance coverage is defined under §601.072 of the Transportation Code.

Minimum Insurance Coverage Of Commercial Vehicles

  • $300,000 for trucks weighing less than 10,001 lbs. and transporting nonhazardous materials
  • $750,000 for trucks weighing at least 10,001 lbs. and transporting nonhazardous materials
  • $1 million for trucks transporting oil
  • $5 million for trucks carrying hazardous materials.

At the very least, all tractor-trailers carry non-hazardous materials required to obtain $300,000 of liability insurance. However, operators of trucks of the same weight that carry hazardous or explosive materials are needed to receive $5,000,000 in liability coverage.  The Texas Department of Insurance has outreach programs established to inform all truck drivers and companies of this responsibility and requirement. Additionally, all trucking companies have a duty under §502.046 of the Transportation Code to demonstrate the financial burden for their vehicles. This can be done through the documents described under §601.053 of the Transportation Code—such as a motor vehicle liability insurance policy, an insurance binder, or a surety bond certificate. Additionally, it can be provided through liability self-insurance, to name a few truck insurance options.
