Though no state bans all cell phone use there are 46 states and the District of Columbia that ban texting while driving as of June of 2017. In the state of Texas, texting is banned throughout the state and punishable by law. A driver can be charged with a Class A misdemeanor and could face jail time for up to one year and fines up to $4,000 if their offense resulted in an accident causing significant harm or death.

The dangers of driving while using cell phones is a reality everyone must face as they have become more ubiquitous. A person is four times more likely to be in an accident if they are using their cell phones while driving. The National Safety Council estimates 1.6 million crashes each year associated with cell phone use while driving. This difficult situation is not going away any time soon.
